SwiftSpot Renter Terms of Service

These Renter Terms of Service ("Renter Terms") govern your use of SwiftSpot's platform as a Renter. These Renter Terms supplement and are incorporated into our general Terms of Service and Privacy Policy. By booking a parking spot or storage space on SwiftSpot, you agree to comply with these Renter Terms, our general Terms of Service, and all applicable policies.

1. Acceptance of Terms

By booking or reserving a parking spot or storage space, you accept these Terms as a binding legal agreement between you and SwiftSpot. If you do not agree to these Terms, you may not use our Services.

2. Eligibility

To use SwiftSpot as a Renter, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Maintain a valid payment method on file

3. Account Registration and Security

You must create and maintain an account with accurate, current information. You are responsible for:

• Safeguarding your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Keeping your account information up to date

4. Booking and Use of Spaces

When you book a parking spot or storage space, you agree to:

• Use the space only for its intended purpose (vehicle parking or item storage)
• Use the space only during the reserved time period
• Follow all rules and restrictions specified by the Host
• Treat the space and surrounding property with respect
• Comply with all applicable laws and regulations
• Not sublease or transfer your booking to others

4.1 Booking Start Time Requirements

Booking start times must be current or in the future. The following grace period rules apply:

• Immediate Bookings (less than 10 minutes duration): No grace period. The booking start time must be at or after the current time. Bookings with start times in the past will be rejected.
• Extended Bookings (10 minutes or longer duration): A 5-minute grace period applies to account for network latency, processing time, and clock synchronization. Bookings with start times up to 5 minutes in the past may be accepted for bookings of 10 minutes or longer.

These rules ensure accurate booking times while accommodating technical delays for longer bookings. For immediate or short-duration bookings, precise timing is required.

5. Fees and Payments

All fees must be paid through our secure payment processor, Stripe.

• Renter Service Fee: CAD short parking about 5% (minimum $0.75); long-term parking and storage use a stepped schedule (about 5% then 3% above higher bases). A $5.00 CAD minimum rental base may apply. Legacy currencies may still use about 7% with a minimum, or a flat $1.00 on very small bookings (shown at checkout)
• Booking total: Listed price plus applicable fees, as displayed before you pay
• Taxes: You are responsible for any applicable taxes unless a tax amount is explicitly shown at checkout
• Payment Security: SwiftSpot does not store your full payment card details
• No cleaning fees or security deposits: SwiftSpot does not add host-set cleaning fees or security deposits at checkout

When you are charged. If your parking start is within approximately 6 days, we may authorize your card at checkout and capture when your parking period begins. Immediate, far-future, and storage bookings are typically captured at checkout. Pay-as-you-go parking uses a temporary authorization (at least approximately $2) and bills for time used when you end your session. Timing is shown at checkout.

5.1 Card verification (fixed bookings)

When you use a card that has not previously been used for a completed SwiftSpot booking, we may place a separate temporary authorization of approximately $1.00 to verify the card. It is not part of your booking total and is released when the booking completes or is cancelled under our policies.

5.2 Late departure (parking)

For fixed-term parking bookings (not pay-as-you-go), you must leave by your scheduled end time. If you overstay:

• Grace period: 10 minutes after scheduled end with no late fee
• After grace: 0.25 per minute, up to a maximum of 50 per booking
• Host report required: Late fees are assessed only when the host reports a late departure; SwiftSpot does not auto-charge without host action
• Extend instead: Use in-app extension before end time when you need more time

6. Cancellations and Refunds

Hosts choose Standard or Flexible cancellation for each listing. Both include a 5-minute post-booking grace. Your booking keeps the policy in effect when you booked. Summary:

Advance notice requirements protect hosts who reserve capacity and may need time to find replacement renters.

Special circumstances (medical emergencies, natural disasters, host cancellation) may qualify for exceptions. Contact [email protected] with documentation.

7. Prohibited Activities

You agree not to:

• Damage the parking spot, storage space, or surrounding property
• Store hazardous, illegal, or prohibited items
• Exceed the booked time without authorization (see Section 5.2 for late departure fees on fixed parking bookings)
• Park vehicles larger than the space accommodates
• Engage in any illegal activities
• Circumvent our payment systems
• Harass or abuse Hosts or SwiftSpot staff

8. Insurance and Liability Disclaimers

SwiftSpot does not provide insurance coverage for:

• Your vehicle or its contents
• Your personal property or stored items
• Damage caused by third parties, weather, or other events
• Theft or vandalism

Risk Acknowledgment: By using our Services, you acknowledge that parking and storage carry inherent risks. We strongly recommend maintaining appropriate insurance coverage for your vehicle and stored items.

9. Disputes and Issue Reports

If something goes wrong during or after your booking, use SwiftSpot's issue-report tools in the app or on the web. Hosts and renters may submit one report per booking for categories such as property damage, mess or items left behind, access issues, or permitted-use / compliance concerns. SwiftSpot reviews reports and may contact parties, adjust refunds, require cure of a problem, or terminate a rental when warranted. Submitting a report does not automatically charge your card. For formal disputes, Section 10 applies.

10. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration conducted in British Columbia, Canada. You agree to waive any right to participate in class actions or class-wide arbitration.

10. Termination

SwiftSpot may suspend or terminate your account for:

• Violation of these Terms or our policies
• Fraudulent or illegal activity
• Repeated complaints from Hosts
• Failure to pay applicable fees

11. Modifications to Terms

SwiftSpot may modify these Terms at any time by posting the revised Terms on our platform. Your continued use of our Services after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any legal action arising under these Terms shall be brought exclusively in the courts of British Columbia.
